O cadastro ambiental rural e o programa de recuperação ambiental: medidas eficazes de preservação e conservação do meio ambiente no município de Caxias do Sul

Abstract

The study provides as topic the Environmental Cadastre and the Program of Environmental Recovery and the preservation and conservation of the Rural environment. From then, the problem was delimited as follows: Are the Rural Environmental Cadastre and the deployment of the Environmental Recovery Program in the Municipality of Caxias do Sul being effective to raise the environment protection’s level, improving the quantity and quality of regularizations, considering the administrative and criminal exemptions to which its adherents are entitled? Therefore, the general objective of the study was to analyze, according to prevailing legislation, the legal literature, official documents and potential case law, whether the Rural Environmental Cadastre and the Environmental Recovery Program are effective measures to protect and preserve the environment in the Municipality of Caxias do Sul. The study was carried out from a descriptive and exploratory study, by quantitativequalitative approach, with case study. For the application of the data collection instrument, statistical data and numeric indicators were obtained through information provided by the Municipal Environment’s Office. Semi-structured interviews with open questions were also conducted with sixteen owners of rural areas in Caxias do Sul, who were defined by progressive inclusion, when the interviews were interrupted due to the saturation criterion. In addition, to support the study, legal literature were aroused and reviewed, making a research of bibliographic references with a later selection and investigation of the aspects that allow to envision the research problem. Finally, the conclusion is that the objective of the research was fully achieved, since the Rural Environmental Registry and the Environmental Recovery Program are being effective measures to preserve and conserve the environment in Caxias do Sul’s Municipality, especially the first one, even if they are result from the controversial changes that came from the recent edition of the Brazilian Forest Code of 2012.
