Este trabalho tem como objetivo analisar o impacto da desinformação nas eleições brasileiras. As redes sociais e plataformas digitais tornaram-se vetores massivos de disseminação de fake news, particularmente visível nas eleições de 2018 e 2022. Por meio do método de investigação de revisão de literatura, busca-se entender como as redes sociais influenciam o processo eleitoral brasileiro por meio da propagação de fake news, e quais instrumentos efetivos de enfrentamento se impõem para garantir eleições íntegras? O ordenamento jurídico brasileiro, fundamentado na Constituição Federal e legislações infraconstitucionais, fornece base para atuação proativa do Poder Judiciário, contudo, constatou-se que esses mecanismos jurídicos isolados são insuficientes para combater efetivamente a desinformação sem comprometer direitos fundamentais como a liberdade de expressão. Conclui-se que a solução reside em uma abordagem integrada e coordenada entre Estado, sociedade civil e plataformas digitais, combinando regulação ponderada, educação digital crítica, responsabilização das plataformas, fortalecimento de agências de fact-checking e participação popular. Abstract
This work aims to analyze the impact of misinformation on Brazilian elections. Social media and digital platforms have become massive vectors for the dissemination of fake news, particularly evident in the 2018 and 2022 elections. Through a literature review investigation method, this study seeks to understand how social media influences the Brazilian electoral process through the spread of fake news, and what effective instruments of confrontation are imperative to ensure fair elections. The Brazilian legal system, grounded in the Federal Constitution and infraconstitutional legislation, provides a basis for proactive action by the Judiciary; however, it has been found that these isolated legal mechanisms are insufficient to effectively combat misinformation without compromising fundamental rights such as freedom of expression. It is concluded that the solution lies in an integrated and coordinated approach among the State, civil society, and digital platforms, combining measured regulation, critical digital literacy, platform accountability, strengthening of fact-checking agencies, and popular participation.
