| dc.description | O presente trabalho teve como objetivo analisar a responsabilidade civil do médico diante das consequências da recusa de transfusão de sangue em pacientes testemunhas de Jeová. A pesquisa visou compreender a colisão entre direitos fundamentais, especificamente o direito à vida (art. 5º, caput da CF/88) e o direito à liberdade religiosa (art. 5º, VI da CF/88). Desenvolvido em três capítulos, o estudo possui natureza teórica e se baseou em análises da doutrina, legislação brasileira e jurisprudência. O primeiro capítulo abordou os direitos fundamentais, visando compreender o embate entre o direito à vida e a liberdade religiosa, buscando alcançar uma resolução para esse conflito. No segundo capítulo, explorou-se a religião das testemunhas de Jeová para entender seus ensinamentos sobre transfusão de sangue e possíveis tratamentos alternativos. Por fim, no terceiro capítulo, analisou-se a responsabilidade civil médica diante das transfusões de sangue em pacientes testemunhas de Jeová. Concluiu-se que a responsabilização civil do médico dependerá do contexto específico, levando em consideração o estado do paciente. Recomenda-se ao profissional, diante de um paciente em risco de vida, aplicar a transfusão de sangue. Se o paciente for maior e consciente, respeitar sua escolha; se estiver inconsciente, verificar a existência de documento prévio indicando tratamentos aceitos ou um representante legal. No caso de paciente menor de idade, priorizar a saúde da criança ou adolescente e aplicar o tratamento necessário. | dc.description.abstract | This study aimed to analyze the physician's civil responsibility concerning the consequences of refusing blood transfusion in Jehovah's Witness patients. The research aimed to understand the clash between fundamental rights, specifically the right to life (Art. 5, Chapter I of the Brazilian Federal Constitution of 1988) and the right to religious freedom (Art. 5, VI of the Brazilian Federal Constitution of 1988). Developed across three chapters, this theoretical study drew from doctrinal analysis, Brazilian legislation, and case law. The first chapter delved into fundamental rights to comprehend the conflict between the right to life and religious freedom, aiming to reach a resolution for this clash. The second chapter explored the beliefs of Jehovah's Witnesses regarding blood transfusions and potential alternative treatments. Finally, the third chapter scrutinized the medical civil responsibility concerning blood transfusions in Jehovah's Witness patients. It was concluded that the physician's civil liability would hinge upon the specific context, taking into account the patient's condition. The recommendation to the professional is as follows: in the case of a patient facing a life-threatening situation, administer the blood transfusion. If the patient is of legal age and conscious, respect their choice; if unconscious, verify the existence of prior documentation indicating accepted treatments or a legal representative.
