| dc.description | O presente trabalho de conclusão de curso tem como objetivo analisar quais são os efeitos jurídicos causados pela migração internacional no Brasil, principalmente nas questões ligadas aos refugiados e apátridas, considerando as grandes levas de migrantes que estão adentrando em território nacional de forma recorrente e em grande número, uma vez que o Brasil é considerado um país pródigo e acolhedor. De anteposto, menciona-se que a vinda de refugiados para o Brasil ocorre em virtude de temores de perseguição sofridos por estes indivíduos quando em seu país de origem. No momento em que o indivíduo decide se refugiar, este deverá estar preparado para enfrentar inúmeras dificuldades, desde as travessias que, geralmente, se dão em pequenos barcos superlotados, não atendendo a qualquer necessidade básica do ser humano, até as dificuldades burocráticas após adentrar em um país, neste caso, o Brasil, considerando que, para ser reconhecido como refugiado e ter seus direitos como tal adquiridos em solo nacional, necessitam preencher determinados requisitos estipulados em lei. No que tange aos apátridas, as dificuldades são ainda maiores, uma vez que não são considerados nacionais de nenhum país, são filhos de ?ninguém? e por isso as medidas a serem tomadas devem ser mais cautelosas e, consequentemente, este processo torna-se mais demorado, permanecendo o indivíduo, até então, sem documentos pessoais, não podendo exercer de forma regular seus direitos da vida civil. Com a pesquisa verificou-se que o Brasil tem estado bem preparado para receber refugiados e apátridas, uma vez que possui diversas leis internas que regulamentam a entrada e permanência destas pessoas, bem como tem sido proativo há anos em relação a tratados e convenções a esse respeito. Além disso, percebeu-se que dispõe de recursos para estabelecer destes povos em território brasileiro e abriga inúmeras organizações em prol dos refugiados e apátridas no país.(sic) | pt_BR |
| dc.description.abstract | The objective of this study is to analyze the legal effects of international migration in Brazil, especially on issues related to refugees and stateless persons, considering the large numbers of migrants who are entering the country on a recurrent and large scale number, since Brazil is considered a lavish and welcoming country. In the foregoing, it is mentioned that the arrival of refugees in Brazil occurs due to fears of persecution suffered by these individuals when in their country of origin. At the moment the individual decides to take refuge, he must be prepared to face numerous difficulties, from the crossings that usually take place in small overcrowded boats, not meeting any basic human need, to the bureaucratic difficulties after entering into a country, in this case Brazil, considering that, in order to be recognized as a refugee and have their rights as such acquired on national soil, they must meet certain requirements stipulated by law. As far as stateless persons are concerned, the difficulties are even greater, since they are not considered as nationals of any country, they are the children of "nobody" and therefore the measures to be taken must be more cautious and, consequently, this process becomes until then, without personal documents, and they cannot exercise their civil rights on a regular basis. The study found that Brazil has been well prepared to receive refugees and stateless persons, since it has several internal laws regulating the entry and stay of these persons, as well as being proactive for years in relation to treaties and conventions to this respect. In addition, it has been found that it has the resources to establish these people in Brazilian territory and houses numerous organizations for the benefit of refugees and stateless persons in the country.(sic) | pt_BR |
